Constitution Day is a significant national holiday in Ukraine, commemorating the adoption of the country’s post-Soviet constitution on 28 June 1996. Historically, this day has been observed as a public holiday, granting citizens a day off work. It represents a cornerstone of Ukraine’s statehood and democratic development following its independence.

However, due to the ongoing martial law enacted in response to the full-scale invasion, the designation of Constitution Day as a non-working public holiday has been temporarily suspended. While the date remains nationally significant, the associated day off is not currently observed. This decision aligns with measures to maintain national productivity during a period of national emergency.

The history of constitutionalism in Ukraine extends back centuries, with notable documents such as the Constitution of Pylyp Orlyk in 1710, considered one of Europe’s earliest constitutional acts. However, the modern Constitution Day specifically refers to the adoption of the Constitution of independent Ukraine. Following the Declaration of Independence in 1991, the newly formed state embarked on the complex process of drafting its fundamental law.

This process was protracted, spanning nearly six years amidst political debates and societal changes. The Verkhovna Rada (Parliament of Ukraine) finally adopted the Constitution on 28 June 1996, after an intense, all-night session known as “constitutional night”. This document established a unitary, parliamentary-presidential republic, defined the rights and freedoms of its citizens, and solidified the country’s sovereignty and territorial integrity. The adoption of the Constitution was a pivotal moment, providing the legal framework for Ukraine’s democratic institutions and cementing its path as an independent nation.

The suspension of its public holiday status came into effect with the implementation of martial law in February 2022. Under martial law, specific legislation was passed that suspended the provisions of the Labour Code regarding public holidays and non-working days. Public celebrations often featured concerts, cultural events, and festivals in city squares and parks. Families and friends would use the public holiday for leisure activities, gathering for picnics or attending community events. Educational institutions would frequently organise themed lessons or discussions on the importance of the Constitution.

Under the current conditions of martial law, large-scale public celebrations are generally not held due to security concerns and the suspension of the non-working day. While the day retains its profound national importance, observances are typically more subdued. Citizens may reflect on the Constitution’s significance privately or participate in smaller, symbolic acts of remembrance or unity, often focusing on the country’s resilience and determination in defending its sovereignty and constitutional principles. The national flag is still displayed, and the day remains a reminder of Ukraine’s foundational legal document.

Constitution Day in Ukraine is observed on a fixed date: 28 June each year. This date corresponds to the day the Constitution was officially adopted in 1996.

The holiday follows the Gregorian calendar system. Although its public holiday status has been suspended, the designated date for commemorating the Constitution remains unchanged. The suspension only affects whether it is a non-working day for the general population, not the historical date of its observance.
